What happens if a tenant fails to pay rent to the court during an eviction appeal?

 

The Texas Property Code requires tenants to continue to pay rent during the eviction appeal process. Instead for paying the landlord directly during the appeal, the tenant is supposed to pay the court and the money is held until the end of the appeal.

If a tenant fails to stay current on payments, the landlord may bring it to a judge's attention through a motion and may be able to get a writ of possession to reclaim their property.
