Can I evict a tenant for demanding repairs to a rental property?

Under Texas law, generally, no, you cannot evict the tenant for demanding repairs to the property. To evict the tenant, the tenant must have materially breached the lease. Under Texas law, a tenant that demands repairs to the property to correct risks to the health, well-being or safety of the occupants of the home has not breached the lease.

If you think your tenant's demands for repairs are an exception to this general rule, we recommend reaching out to an attorney prior to attempting to evict your tenant.
